Wrongful Death Causes Linked to Spinach Settled

Last year over 200 people became sick after eating spinach that had been contaminated with E. coli. Three families that lost loved ones sued the companies that sold the spinach for wrongful death. Those cases have now been settled out of court, but their terms have been sealed.

Natural Selection Foods spokeswoman Samantha Cabaluna said: "We are hopeful that these settlements bring some closure."
"Everyone at Natural Selection Foods remains deeply saddened by the human toll of the outbreak," Cabaluna said. "As we said we would do from the beginning we tried to work as honestly, fairly and expeditiously as possible to resolve the cases."

There are still almost 90 cases pending over the contaminated spinach. Investigators believe pigs may have spread E. coli in the spinach field.

Asbestos Wrongful Death Lawsuit Filed

A Tennessee woman filed a $20 million wrongful death lawsuit last week claiming that her husband's death was a result of his exposure to asbestos while he was on the job. Donald Welch died of esophageal cancer in July 25. His wife is seeking $10 million in compensatory damages and $10 million in punitive damages.

``Even though ALCOA was familiar with reports of family member contraction of mesothelioma (asbestos-related cancer) from workers' clothes as early as 1968 and worker contraction of mesothelioma from intermittent exposures as early as 1964, at no time did ALCOA advise Donald Welch of these risks so that he could take reasonable precautions,'' according to Carolyn Welch's suit.

Welch worked for a contractor on several occasions at ALCOA.
